Terms of service
Last updated 15 October 2026
These terms are an agreement between you and fxapis, operated by El Wizard (business ID 207370523), Jacó, Puntarenas 61101, Costa Rica (“fxapis”, “we”, “us”). They cover the fxapis API, the web console at fxapis.com, the documentation at docs.fxapis.com and anything else we provide under the fxapis name (together, the “Service”). By creating an account, issuing an API key or otherwise using the Service, you accept these terms. If you accept them for a company or other organisation, you confirm you are authorised to bind it, and “you” means that organisation.
These terms incorporate our Privacy policy, our Data management terms, our Risk disclaimer and our Refund policy. A signed order form or enterprise agreement, where you have one, takes precedence over these terms to the extent they conflict.
1. What fxapis is — and is not
fxapis provides software that connects to MetaTrader 5 (“MT5”) trading accounts held with brokers you choose, keeps those connections available, and transmits the trading instructions you send through the API or the console. It records what happened to each instruction and makes that history available to you.
- We are not a broker, dealer, exchange, investment firm or financial adviser. We do not open trading accounts, hold client money or assets, set prices, match orders or execute trades as principal or agent. Your broker does those things, under its own terms and regulation.
- We do not decide what to trade. Every order is created by you, your software, or someone you have given access to. We do not generate signals, recommendations or strategies, and nothing in the Service is investment, financial, legal or tax advice.
- We act only on instructions. We transmit the instructions received with your credentials. We do not review whether an instruction is wise, suitable for you or your end users, or permitted by your broker.
- MetaTrader and MetaTrader 5 are trademarks of MetaQuotes Ltd. fxapis is independent and is not affiliated with, endorsed by or sponsored by MetaQuotes or any broker.
2. Who may use the Service
- You must be at least 18 years old and able to enter a binding contract.
- The Service is intended for businesses and professional developers. If you are an individual using it for your own account, you do so at your own risk and must still meet every requirement in these terms.
- You may not use the Service if you are subject to sanctions administered by the United Nations, the European Union, the United Kingdom or the United States, or are located in, or ordinarily resident in, a country or territory subject to comprehensive sanctions, or if using it would break the law that applies to you.
- It is your responsibility to know whether the activity you use the Service for — including operating trading accounts on behalf of others, copying trades, or offering signals — requires a licence, registration or disclosure where you or your customers are, and to hold it.
3. Your fxapis account, workspace and team
- You create an account with an email address and password. You must give accurate information and keep it up to date. The person who creates a workspace is its owner and may invite others with roles that control what they can do.
- The workspace owner is responsible for everyone they invite, for the keys issued in the workspace, and for everything done with them. Remove people and revoke keys as soon as they should no longer have access.
- Keep your password confidential and tell us promptly at [email protected] if you believe your account is compromised.
4. API keys
- API keys are credentials. Anyone holding a key can do everything its scopes allow — including placing and closing trades — and we will treat those actions as yours.
- Keep keys on servers you control. Do not put them in browsers, mobile apps, public repositories, logs, support tickets or anywhere else they could be read by others. Issue the narrowest scopes that will do the job, test with broker demo accounts (test keys are a label and reach real brokers too), and rotate keys regularly.
- We show a key once, when it is created, and cannot recover it. If a key may have been exposed, revoke it immediately in the console; revocation takes effect on its next use.
5. Connecting MT5 accounts
When you connect an MT5 account, you confirm and promise that:
- you own the account, or you have the account holder's documented, current and informed permission to connect it to the Service and to trade on it through the Service, and you will stop immediately if that permission is withdrawn;
- the broker's terms allow the account to be accessed and traded through third-party software, automated systems or an API, and you will comply with those terms, including any limits on order frequency, strategies or instruments;
- the credentials you provide are the ones the account holder intends to be used, and you will keep them up to date;
- where you connect accounts belonging to your own customers or end users, you have given them any notices and obtained any consents the law requires, including for sharing their data with us as described in our Data management terms.
We store MT5 passwords encrypted and use them only to log the account in at its broker so the Service can operate it. You can disconnect an account at any time, which erases its stored password.
6. Trading through the Service
- You decide every order. You are solely responsible for the orders sent with your credentials, including their size, direction, instrument, timing, stop loss and take profit, and for any losses, costs, margin calls or liabilities that follow.
- Execution is up to your broker. Brokers may reject, requote, delay, partially fill, re-price or close orders and positions, and may change their terms, symbols, trading hours or leverage at any time.
- Outcomes can be temporarily unknown. If a connection fails after an order is sent, we may not know whether the broker received it. We report such orders as unconfirmed and establish the result from the broker's records; you must not resend an order that is unconfirmed. Follow the retry guidance in the documentation, including the use of idempotency keys.
- Multi-account orders are not atomic. An order sent to many accounts at once produces a separate order per account; some may fill at different prices, and some may not fill at all.
- Latency and availability vary. Accounts may need time to come online, connections to brokers can drop, and performance figures we publish are measurements, not promises.
- Stop losses and take profits you set are held by your broker and generally continue to operate when an account is offline in fxapis. Any logic you run in your own systems is your responsibility.
7. Acceptable use
You must not, and must not allow anyone else to:
- connect or trade any account you are not authorised to operate, or use credentials obtained without permission;
- use the Service for market manipulation, spoofing, layering, wash trading, front-running, abusive latency or price-feed arbitrage, or any other practice prohibited by law or by your broker;
- use the Service to operate an unlicensed investment, portfolio-management, brokerage or money-transmission business, or to promise or market guaranteed returns;
- use the Service for fraud, money laundering, terrorist financing, sanctions evasion, or any other unlawful purpose;
- interfere with the Service or other customers — including exceeding rate limits by design, load or security testing without our written permission, probing for vulnerabilities outside our disclosure process, or attempting to reach data that is not yours;
- reverse engineer, copy, resell or sublicense the Service, or use it to build a competing service, except as the law expressly permits;
- share accounts or keys between unrelated organisations, or misrepresent who you are or who you act for.
If you find a security vulnerability, report it to [email protected] and give us reasonable time to fix it before disclosing it.
8. Plans, fees and payment
- Plans, prices, allowances and features are those shown on our pricing and billing pages when you subscribe, or in your order form. Prices are in US dollars unless stated otherwise and exclude taxes, which you are responsible for where they apply.
- Paid plans are billed monthly in advance and renew automatically until cancelled. Card payments are processed by our payment provider; cryptocurrency payments are processed by our crypto payment provider. We never receive your full card number.
- Usage above your plan's allowance may be charged as overage where your plan allows it, up to the ceiling described in the documentation, after which new orders are refused. Closing positions and cancelling orders is never refused for billing reasons.
- We may offer a free plan and may change or withdraw it. If no free plan is offered, a workspace without a paid plan can still close positions and cancel orders but cannot connect accounts or open new trades.
- We may change prices for future billing periods with at least 30 days' notice. Cancellation and refunds are governed by our Refund policy.
- If a payment fails, we may retry it and, if it cannot be collected, end the paid plan. We may suspend access for accounts with amounts overdue after notice, but never in a way that prevents you from closing positions.
9. Availability, changes and support
- We work to keep the Service available and reliable, but it is provided without a service-level commitment unless you have a signed agreement that includes one. Maintenance, incidents at our providers or your broker, and events outside our control can interrupt it.
- We may change the Service, including adding or removing features, and will give reasonable notice of changes that remove functionality you rely on or break the documented API. We version the API and publish changes in the changelog.
- During a security or stability incident we may temporarily switch off trading for a workspace or the platform. We will tell affected customers as soon as practical.
- Support is provided by email at [email protected], on a reasonable-efforts basis unless your agreement says otherwise.
10. Your data
- You own the data you and your systems provide to the Service and the records it creates of your activity (“Customer Data”). You give us the rights we need to host, process and transmit it to provide, secure and support the Service.
- We process personal data as described in our Privacy policy, and personal data within Customer Data as your processor under our Data management terms.
- We may use aggregated, de-identified information about how the Service is used — which cannot identify you, your end users or your trading — to operate and improve it.
11. Our intellectual property
The Service, including its software, documentation, design and the fxapis name and logo, belongs to us and our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription in line with these terms. Sample code in the documentation may be used freely in your own integrations. If you send us feedback, we may use it without obligation to you.
12. Confidentiality
Each of us will keep the other's non-public information confidential, use it only for the purposes of this agreement, and protect it with at least reasonable care. This does not apply to information that is public through no fault of the recipient, was already known to it, is independently developed, or must be disclosed by law — in which case the recipient will give notice where lawful.
13. Suspension and termination
- You may stop using the Service and close your account at any time. Cancel any paid plan first.
- We may suspend or terminate your access, or disconnect accounts, with notice where practical, if you materially breach these terms, if we reasonably believe your use is unlawful, unauthorised or harmful to the Service, other customers, account holders or brokers, if required by law or a competent authority, or for non-payment.
- Where we can do so safely and lawfully, we will let you close open positions and export your data before access ends. After termination we delete or retain data as described in our Data management terms.
- Sections that by their nature should survive termination — including fees owed, disclaimers, limitation of liability, indemnity, confidentiality and governing law — survive it.
14. Disclaimers
To the fullest extent the law allows, the Service is provided “as is” and “as available”. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted or error-free operation. We do not warrant any trading result, execution quality, price, latency or broker behaviour. Our Risk disclaimer forms part of these terms.
15. Limitation of liability
- To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, trading gains, business, goodwill or data, however caused.
- In particular, we are not liable for trading losses, missed or delayed trades, slippage, requotes, broker rejections, margin calls or stop-outs, or for the acts or omissions of brokers, MetaQuotes, payment providers, hosting providers or other third parties.
- Our total liability arising out of or relating to the Service in any twelve-month period is limited to the fees you paid us for the Service in the twelve months before the event giving rise to the claim, or US$100 if you paid nothing.
- Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by negligence.
16. Indemnity
You will defend and indemnify us, and our officers, employees and contractors, against claims, losses, fines and reasonable costs (including legal fees) arising from: your trading or your customers' trading through the Service; any account you connect without proper authority; your breach of these terms, your broker's terms or the law; or services you provide to your own customers using the Service.
17. General
- Changes to these terms. We may update these terms. We will give at least 30 days' notice by email or in the console of changes that materially reduce your rights; other changes take effect when published. Continuing to use the Service after a change takes effect means you accept it.
- Force majeure. Neither party is liable for failure or delay caused by events beyond its reasonable control, including failures of brokers, networks, hosting or payment providers, and acts of government.
- Assignment. You may not transfer this agreement without our consent. We may transfer it to an affiliate or to a successor to our business, with notice.
- Governing law and disputes. These terms are governed by the laws of Costa Rica, without regard to conflict-of-law rules. Disputes will be heard exclusively by the competent courts of the Republic of Costa Rica, except that either party may seek urgent injunctive relief anywhere. Before bringing a claim, each party will try in good faith to resolve the dispute by written notice and discussion for at least 30 days.
- Entire agreement. These terms and the documents they incorporate are the whole agreement between us about the Service. If any part is unenforceable, the rest remains in effect. A failure to enforce a right is not a waiver of it.
- Notices. We send notices to the email address of your workspace owner. Send notices to us at [email protected] and, for formal notices, to Jacó, Puntarenas 61101, Costa Rica.
